Privacy policy.

What we collect, why, and how to get it back or gone. Written so a human can actually read it.

01Who we are

This policy covers Fresh Lime Media LLC, doing business as Peak Engine ("Peak Engine", "we", "us"), based in American Fork, Utah. It applies to peak-engine.com, the Peak apps (including app.peak-engine.com and go.peak-engine.com), our calls, text messages and emails, and the services we provide to clients. It does not cover websites or services run by others, even if we link to them.

02What we collect

Information you give us. When you fill out a form, request a Revenue Leak Audit, call, text, email, book a call or become a client, we collect what you send, such as:

  • Name, email, phone number, company name and job title
  • Your website address, trade, service area and details about your business
  • Your message and the service you're interested in
  • Whether you agreed to receive texts and calls, with the date, time, page and wording you agreed to
  • Billing details for clients (payments are handled by Stripe; we don't store full card or bank account numbers)
  • What you say on calls with us, which may be recorded and transcribed

Information collected automatically. When you visit the site, we and our analytics and ad tools collect:

  • Pages viewed, time on page, clicks, scrolls, and the site or ad that sent you
  • Campaign tags in the link you followed (UTM tags, gclid, fbclid), kept in your browser so a form can tell us which ad brought you in
  • Device type, browser, operating system, IP address and approximate location from it, and cookie or similar identifiers
  • Session recordings of how you move through pages (with typed form inputs masked), if session replay is turned on in our analytics

Information in the Peak apps. If you use the Peak apps, we collect your account details (name, email and profile photo from Google sign-in), your settings, security logs (sign-ins, IP address, device, and actions taken), support requests, and the business data you or your team put in.

Information from others. We may get information about your business from public sources (your website, Google Business Profile, reviews, state license lookups), from ad platforms (ad performance and lead forms), and from people who refer you to us.

Your customers' information. When we run follow-up, phone answering, ads or the apps for a client, we handle information about that client's leads and customers, such as names, phone numbers, emails, addresses, messages, call recordings and job details. See "If you're one of our clients' customers" below.

03Sensitive information

We don't ask for, and you shouldn't send us, Social Security numbers, driver's license numbers, full bank or card numbers, medical or health information, or similar sensitive data through our forms, texts or the apps.

We don't collect biometric identifiers. Call recordings are used to deliver and improve the service, not to create voiceprints or identify people by their voice.

We are not a HIPAA business associate unless we've signed a business associate agreement with a client. For clients in health-related fields (like med spas), we handle any health information their customers share only as that client's processor, under its instructions.

04How we use it

  • Reply to you, prepare your audit, and schedule calls
  • Set up, run and support the services and apps you pay for
  • Call, text and email you about your request or account, if you agreed to it
  • Send texts, emails and calls on behalf of our clients, as they direct
  • Bill clients, keep records and collect what's owed
  • Measure which pages and ads work, and improve the site, services and apps
  • Create de-identified or combined data (for example, average response times across trades) that doesn't identify you or your customers
  • Send occasional updates if you signed up for them (unsubscribe any time)
  • Keep the site and apps secure, prevent fraud, spam and abuse, and enforce our terms
  • Follow the law and respond to legal requests

We don't make decisions about you based only on automated processing that have legal or similarly significant effects.

05AI, calls and recordings

We use AI tools to help answer phones, reply to leads, summarize calls and draft messages, for us and for our clients. These tools process the content of calls and messages to do that job. We use AI providers under commercial terms that restrict them from using that data to train their general models.

Calls with us or with phone lines we run for clients may be recorded, transcribed and answered by an AI assistant. We aim to tell you at the start of a recorded call. You can always ask whether a call is being recorded or whether you're talking to AI, and we'll tell you. If you don't want to be recorded, hang up and email us instead.

06Text messages

If you give us your mobile number and check the box agreeing to texts, we may text you about your audit, your inquiry, appointments, your account and our services, including with automated technology. Agreeing is never a condition of buying anything. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also opt out any other reasonable way, such as telling us on a call or emailing us; we process those within 10 business days.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text message opt-in data and consent are not shared with any third parties, except the providers that deliver the messages for us.

07Email

Every marketing email we send has an unsubscribe link, and we honor unsubscribes promptly. You'll still get emails about your account, invoices and service if you're a client.

08Google sign-in and Google data

The Peak apps let you sign in with Google. When you do, Google shares your name, email address and profile photo with us. We use them only to sign you in, show who you are in the apps, and secure your account.

If you connect a Google service (for example Google Business Profile or Google Ads) to have us run it, we access only the data needed to provide that feature, and only for you.

Peak Engine's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. We don't sell Google user data, use it for advertising, or use it to train general AI models. People at Peak Engine read it only with your permission, to fix a problem, for security, or when the law requires it.

09Who we share it with

We do not sell your personal information for money. We share it only with:

  • Service providers that help us run the business, under contracts that limit how they use it: hosting and databases (Vercel, Neon), the CRM and messaging platform we use (HighLevel/LeadConnector and its phone carriers), email delivery (Resend), payments (Stripe), forms and e-signatures (Jotform), AI providers that power instant replies, call summaries and phone answering (such as Anthropic), analytics (PostHog, Google Analytics), and our accountants and lawyers
  • Ad platforms (Google and Meta), through their site tags, so we can measure our ads and show them to people likely to need us
  • The client you contacted, if you reached one of our clients through a site, ad or phone line we run for them
  • Phone carriers and registries, to register business texting as carriers require
  • Legal and safety: to follow the law, a court order or a valid legal request, or to protect rights, property or safety, including collecting money owed
  • A buyer or successor, if the business is sold, merged or reorganized, under this policy
  • Anyone else, with your permission

Some state laws treat ad tools like Google and Meta tags as "sharing" personal information for targeted advertising. You can opt out of that, as described next.

10Cookies, ad tracking and your choices

We use cookies and similar tools for analytics and ad measurement. They load only on the live site. You can:

  • Turn on Global Privacy Control in your browser. When we detect it, our Google Ads and Meta tags don't load and Google Analytics runs with ad features off. We treat it as a request to opt out of sale and sharing for that browser.
  • Use the Your Privacy Choices link in the site footer to turn off our ad tags in that browser
  • Block or delete cookies in your browser settings
  • Opt out of Google Analytics with Google's opt-out add-on
  • Manage Google ads at My Ad Center and Meta ads in your Meta ad preferences
  • Email hello@peak-engine.com to opt out of any sharing for targeted advertising

There's no common standard for browser "Do Not Track" signals, so we don't respond to them. We do honor Global Privacy Control as described above.

11If you're one of our clients' customers

If you called, texted or filled out a form for a business we work for, that business controls your information, and we handle it on their behalf and under their instructions. Their own privacy policy applies. To see, fix or delete your data, contact that business. You can also email us and we'll pass the request on and help them handle it.

To stop texts from a business we run messaging for, reply STOP to any message.

12How long we keep it

We keep information as long as we need it for the reasons in this policy. Inquiries that don't become clients are kept up to 5 years so we can prove texting and calling consent, then deleted or anonymized. Client records are kept for the life of the relationship, then as long as needed for taxes, billing, disputes and the law (usually up to 7 years). When a client's plan ends, we export their data on request and delete it from the Peak apps within 90 days of a written request, except backups, which roll off on their normal schedule, and anything the law requires us to keep.

13How we protect it

We use encryption in transit, encrypted storage for sensitive settings, access controls, Google sign-in, and security logs. Each client's data in the Peak apps is kept separate from every other client's. No system is perfectly secure, and we can't guarantee that information will never be accessed, used or lost without permission. If a breach affects your personal information, we'll notify you as the law requires.

14Your privacy rights

Depending on where you live (including Utah, California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with privacy laws), you can ask us to:

  • Confirm whether we have personal information about you, tell you what it is, and give you a copy in a portable format
  • Correct it
  • Delete it
  • Opt out of targeted advertising, sale or sharing, and profiling
  • Limit use of sensitive information (we don't use it for anything that requires this)

Email hello@peak-engine.com or call (801) 822-9439. We'll verify your identity by matching information we already have, then answer within 45 days (we may extend once by 45 more days and will tell you why). An authorized agent can ask for you with your signed permission. We won't treat you differently or charge you more for using these rights. If we deny a request, reply to our answer to appeal; we'll respond within 45 days, and if you're still unhappy you can contact your state attorney general.

We're below the size thresholds of most state privacy laws, including the CCPA. We offer these choices to everyone voluntarily and handle requests as described here.

15California notice

In the last 12 months we have collected these categories of personal information, from the sources and for the purposes described above:

  • Identifiers (name, email, phone, IP address, cookie IDs)
  • Customer records (business details, billing information)
  • Commercial information (services bought, invoices)
  • Internet activity (pages viewed, clicks, ad interactions)
  • Approximate geolocation (from IP address)
  • Audio and electronic information (call recordings, messages)
  • Professional information (company, title, trade)
  • Inferences (which services you may be interested in)

We disclose these to the service providers listed above for business purposes. We "share" identifiers and internet activity with Google and Meta for targeted advertising, which you can opt out of as described above. We don't sell personal information for money, and we have no actual knowledge of selling or sharing information of anyone under 16. We don't use sensitive personal information to infer characteristics about you.

Under California's "Shine the Light" law, you can ask once a year whether we shared personal information with third parties for their own direct marketing. We don't.

Nevada residents can ask us not to sell their covered information. We don't sell it, but you can still send a request to the email above.

16Visitors outside the United States

Our services are meant for businesses in the United States. Information is stored and processed in the United States, where privacy laws may differ from yours. If you're in the EU, UK or a similar place, we rely on your consent, our contract with you, and our legitimate interest in running and improving our business as the legal grounds for processing. You may have rights to access, correct, delete, restrict or object to processing, move your data, withdraw consent, and complain to your local data protection authority. Contact us to use them.

17Children

Our site and services are for businesses and adults. They are not directed to children, and we don't knowingly collect information from anyone under 16. If you think a child sent us information, email us and we'll delete it.

19Changes to this policy

We may update this policy. We'll change the date at the top, and if the change is significant, we'll tell clients by email before it takes effect. If a change affects how we use information we already have, we'll ask for consent where the law requires it.
