01Who is who#
The document comes from the business that sent it (the "Sender"). The Peak apps, run by Fresh Lime Media LLC dba Peak Engine, only provide the tool that shows the document and records your signature. Peak Engine isn't a party to your agreement with the Sender and doesn't give legal advice. Questions about the document go to the Sender.
02Agreeing to sign electronically#
By clicking "I agree", you confirm that:
- You agree to receive and sign this document and related notices electronically, and your electronic signature has the same legal effect as a handwritten one.
- You can open and read this document on your device.
- You have an email address the Sender can use to send you copies.
03Your rights#
These are the federal ESIGN Act consumer disclosures (15 U.S.C. § 7001(c)). They apply when you're signing as a consumer and the law requires the information in writing. We show them every time; the Sender decides whether they apply.
- Paper option. You can ask the Sender for a paper copy, or sign on paper instead. The Sender must tell you about any fee for that.
- Withdrawing consent. You can withdraw consent to electronic records any time before you sign, by contacting the Sender or by not clicking "I agree". Withdrawing doesn't undo signatures already made. After you sign, your agreement may limit withdrawal.
- Scope. Your consent covers this document and records about this transaction, unless the Sender tells you otherwise.
- Keep your contact details current. Tell the Sender if your email or phone number changes.
- Copies. You can download and print the signed document and the signing record. The Sender should also keep a copy for you.
- What you need. A device with a current web browser, an internet connection, and a PDF reader to open the downloaded copy. We'll tell you if that changes in a way that could keep you from reading your records.
04What we record#
Your name and email, the document version and a fingerprint (hash) of it, the date and time, IP address, device and browser details, each step you take (opened, agreed, signed), and your typed, drawn or selected signature. This record is attached to the signed document.
05Documents that can't be signed electronically#
Federal and state law exclude some documents from electronic signing, including wills and testamentary trusts, some family-law documents, court documents, and notices of utility shutoff, foreclosure, eviction, health or life insurance cancellation, product recalls and hazardous materials (15 U.S.C. § 7003). Utah's Uniform Electronic Transactions Act is at Utah Code Title 46, Chapter 4. The Sender is responsible for not using electronic signature where it isn't allowed, and for any required contract language and cancellation notices for home-improvement and contractor work.
06Privacy and contact#
For this transaction, the Sender controls your information and Peak Engine processes it for them. See our Privacy Policy.
